These Terms of Service ("Terms"), together with the Therapick Privacy Policy and any additional terms, disclosures, or feature-specific terms presented to you in connection with particular services or paid features (collectively, this "Agreement"), govern your access to and use of the Therapick website, platform, and related services operated by About Me Agency, LLC, a California limited liability company ("Therapick," "we," "us," or "our"). By accessing or using Therapick, you agree to be bound by this Agreement. If you do not agree, do not use Therapick.
Important: Therapick is a directory, search, discovery, and introductory-contact platform only. Therapick is not a healthcare provider, therapy practice, coaching practice, insurer, crisis service, or emergency response service. Therapick does not provide medical advice, mental health treatment, diagnosis, or crisis intervention.
Therapick is an online directory that allows therapists, counselors, psychologists, coaches, and other approved professionals ("Professionals") to create public profiles and allows members of the public ("Visitors") to search for and contact those Professionals.
Therapick may include features such as public listings, profile photos, written bios, specialties, insurance and fee information, location and availability filters, direct contact forms, embedded video introductions, profile analytics, premium placement, badges, and other search or profile tools we may offer from time to time.
Premium features may include, without limitation, embedded YouTube videos, priority placement in certain search contexts, profile analytics, badge features, and other functionality described on the Site, in your dashboard, or at checkout.
Therapick facilitates discovery and initial contact only. Therapick is not a party to any therapeutic, coaching, consulting, or other professional relationship formed between a Visitor and a Professional, and we are not responsible for any agreements nor services provided by any Professional.
We may add, remove, suspend, or modify any feature or functionality of Therapick at any time, with or without notice, subject to applicable law.
You must be at least 18 years of age to use Therapick.
To create or maintain a listing on Therapick, you must:
If you are a coach or other non-licensed provider, you may not represent yourself as a therapist, psychologist, counselor, or other licensed mental health provider unless you are legally authorized to do so. You are solely responsible for ensuring that your descriptions of your services comply with applicable law, licensing rules, advertising rules, and professional ethics requirements.
We reserve the right to verify credentials, request supporting documentation, refuse or remove listings, or suspend access where we believe a listing does not meet our standards or may create legal, safety, reputational, or consumer-protection risk.
To access certain features, including creating or managing a listing, you must register for an account. You agree to:
Accounts are personal to the registered user and may not be sold, transferred, or assigned without our prior written consent.
We may suspend, restrict, or terminate accounts that contain inaccurate information, violate this Agreement, pose security or fraud risk, generate repeated complaints, or otherwise create legal or operational risk for Therapick or its users.
You are solely responsible for the accuracy of your listing and all information you submit or maintain on Therapick, including your name, credentials, license number, license state, practice type, location, fees, insurance information, specialties, experience, session format, availability, and whether you are accepting new clients.
Misrepresenting your qualifications, licensure, pricing, insurance participation, availability, identity, photos, or services is grounds for immediate rejection, removal, suspension, or termination and may be reported to appropriate authorities where permitted or required by law.
By submitting or maintaining a listing, you represent and warrant that all credentials and qualifications described in your listing are valid, current, and accurate. Therapick may verify your license or credentials using public or third-party sources, but we are not obligated to do so and do not guarantee ongoing verification.
If any license, certification, registration, or other credential lapses, is suspended, restricted, or revoked, or if your scope of practice materially changes, you must immediately update your listing or remove it.
Your profile must accurately reflect the individual Professional named in the listing. Unless expressly authorized by Therapick in writing, profiles may not primarily advertise a clinic, call center, staffing service, group brand, agency, or other third party.
You may not use Therapick to capture inquiries and then redirect prospective clients to a different provider, organization, or intake system in a misleading or bait-and-switch manner.
If you upload, link, or display profile photos, logos, gallery images, or videos:
You may not use stock photos, AI-generated likenesses, voice clones, or edited media in a way that creates a false or misleading impression about your identity, credentials, office, availability, or services.
If Therapick allows Premium video profiles, those videos may be embedded from YouTube or another third-party provider approved by Therapick. You are solely responsible for the content of your videos and for complying with the terms of the applicable hosting platform.
By submitting articles or perspectives for publication on Therapick, you grant us a non-exclusive, royalty-free license to publish, display, and distribute that content on the platform. You represent that your submissions are original, do not infringe any third-party rights, and do not constitute clinical advice to specific individuals.
You are responsible for keeping the following information current where applicable:
All communications with prospective or current clients initiated through Therapick are your sole responsibility. You agree to handle all inquiries in accordance with applicable laws, licensing rules, privacy obligations, advertising rules, and your professional ethical duties.
All listings are subject to review and approval by Therapick. We may approve, reject, edit for formatting, suppress, deprioritize, remove, or request changes to any listing or content at any time, with or without notice, for legal, safety, quality, authenticity, consumer-protection, operational, or reputational reasons.
When using Therapick, you acknowledge and agree that:
Submitting a contact form, watching a video, reading a profile, using search filters, or otherwise using Therapick does not create a therapist-client, doctor-patient, counselor-client, coach-client, fiduciary, or other professional relationship between you and Therapick or, by itself, between you and any Professional.
When you submit a message through a Therapick contact form, your message and the contact information you provide may be transmitted to the Professional by email or other communication channels and may not be fully secure. Do not use Therapick contact forms to send emergency requests, detailed medical records, Social Security numbers, payment card information, or other highly sensitive information.
Therapick may collect or review limited metadata associated with contact forms or platform communications, such as sender name, email address, reason for contact, timestamps, and anti-abuse or security signals, as described in our Privacy Policy.
Therapick may use filters, ranking logic, sorting tools, profile-completeness signals, recency, engagement signals, Premium status, or other factors to determine how listings are displayed in search results or elsewhere on the platform.
A listing's order, visibility, "Best Match" placement, badge, or other prominence does not constitute an endorsement, referral, recommendation, warranty, or guarantee by Therapick.
If we display a "verified" badge or similar indicator, that badge means only that we reviewed certain information or account-level details according to our internal processes. It does not mean that we guarantee licensure, identity, service quality, treatment outcomes, or continued compliance.
Therapick may offer both free listings and paid subscription plans ("Premium"). The features, pricing, billing intervals, and benefits associated with each plan will be described on the Site, in your account dashboard, or at checkout. We may change, modify, or discontinue plans or features at any time, subject to applicable law.
If you enroll in a paid subscription, you authorize Therapick and its third-party payment processor to charge your selected payment method for all applicable subscription fees, taxes, and other charges associated with your plan at the time of purchase and on a recurring basis thereafter until canceled.
Unless otherwise stated at checkout, Premium subscriptions renew automatically at the end of each billing period on a monthly or annual basis, depending on the plan you selected. By purchasing a subscription, you agree to the automatic renewal terms presented at checkout and authorize recurring charges until cancellation.
Payments may be processed by Stripe or another third-party payment processor designated by Therapick. We do not store your full payment card information. Payment processing is subject to the applicable processor's terms and privacy practices.
You may cancel your Premium subscription at any time through your account dashboard or by contacting us at hello@therapick.com. Upon cancellation, your Premium subscription will terminate immediately, your access to Premium features will end, and your listing will revert to the then-available free or basic listing, if any.
If you cancel during an active billing period, Therapick will issue a prorated refund for the unused portion of that billing period to your original payment method within a reasonable time after cancellation is processed. The refund will be calculated based on the number of unused days remaining in the current billing period at the time of cancellation.
We may withhold, delay, or deny a refund to the extent reasonably necessary to address fraud, abuse, chargebacks, payment disputes, or other misuse of the platform.
Cancellation stops future recurring charges. Any charges incurred before cancellation, including charges for the portion of the billing period already used, remain payable. If your account is canceled or terminated because of fraud, misuse, or violation of these Terms, Therapick may deny refunds to the extent permitted by law.
If a charge is declined or a payment method fails, we may retry the payment, suspend Premium features, downgrade your account to a free or basic listing, or terminate your subscription until payment is successfully completed.
We may change subscription prices or features prospectively. If we do, we will provide notice as required by applicable law. Your continued use of Premium after the new pricing takes effect constitutes acceptance of the updated price.
You are responsible for any applicable sales, use, value-added, or similar taxes associated with your purchase, other than taxes based on Therapick's net income.
Free or basic listings may be offered at our discretion. We reserve the right to modify, limit, suspend, or discontinue free listing features at any time, subject to applicable law.
The Therapick name, logo, branding, design, software, compilations, text, graphics, page layouts, search tools, and other content created by or for us ("Therapick Content") are owned by About Me Agency, LLC or its licensors and are protected by copyright, trademark, and other laws.
You may not copy, reproduce, distribute, scrape, republish, sell, license, reverse engineer, create derivative works from, or otherwise exploit Therapick Content except as expressly allowed by this Agreement or with our prior written consent.
You retain ownership of the content you submit to Therapick, including listing information, photos, videos, articles, and messages you create ("Your Content").
By submitting Your Content, you grant Therapick a worldwide, non-exclusive, royalty-free license to host, store, reproduce, display, distribute, format, transmit, and otherwise use Your Content as reasonably necessary to operate, display, promote, secure, moderate, and improve the platform and your listing.
This license includes the right to:
If you close your account or remove content, we will stop publicly displaying that content within a commercially reasonable period, except that cached, archived, backup, legal-retention, or previously shared promotional materials may persist for a reasonable time.
If you believe content on Therapick infringes your copyright, please contact us at hello@therapick.com with details of the alleged infringement.
You agree not to, and not to permit others to, use Therapick to:
We may, but are not required to, monitor access to and use of Therapick, investigate suspected violations, preserve or disclose information where reasonably necessary for legal compliance, fraud prevention, risk assessment, customer support, enforcement, or protection of users or the public, and remove, disable, suppress, or restrict access to content or accounts that we believe violate this Agreement or create risk.
Therapick is a directory and introductory-contact platform only. Nothing on Therapick, including profiles, videos, blog content, contact tools, search results, or other materials, constitutes medical advice, mental health advice, diagnosis, treatment, or crisis intervention.
You should not rely on Therapick as a substitute for in-person or telehealth consultation with a qualified licensed professional.
If you are experiencing a medical or mental health emergency, having thoughts of self-harm, or believe you or another person is in immediate danger, call 911, call or text 988, contact emergency services, or go to the nearest emergency room immediately. Do not rely on Therapick for emergency assistance.
Therapick is provided "as is" and "as available," without warranties of any kind, express or implied, including warranties of merchantability, fitness for a particular purpose, title, non-infringement, accuracy, availability, or that the platform will be uninterrupted, error-free, or free of harmful components.
We do not guarantee:
Therapick is not responsible for any disputes, injuries, losses, damages, cancellations, no-shows, misconduct, malpractice claims, billing disputes, or other claims arising out of or related to interactions between Visitors and Professionals.
To the fullest extent permitted by law, About Me Agency, LLC and its affiliates, officers, directors, employees, contractors, and agents will not be liable for any indirect, incidental, special, exemplary, consequential, or punitive damages, or for any loss of profits, revenues, goodwill, data, opportunity, or business interruption, arising out of or related to your use of Therapick.
Our aggregate liability for all claims arising out of or relating to Therapick or this Agreement will not exceed the greater of (a) the amount you paid us in the twelve (12) months before the event giving rise to the claim, or (b) $100.
If you are dissatisfied with Therapick, your sole and exclusive remedy is to stop using the platform.
You agree to defend, indemnify, and hold harmless About Me Agency, LLC and its affiliates, officers, directors, employees, contractors, and agents from and against any claims, liabilities, damages, judgments, awards, losses, costs, and expenses, including reasonable attorneys' fees, arising out of or related to:
We may suspend, restrict, or terminate your account, listing, subscription, or access to all or part of Therapick at any time, with or without notice, for any reason, including if we believe you violated this Agreement, created risk, provided inaccurate information, or engaged in conduct inconsistent with the platform's purpose or standards.
You may stop using Therapick at any time. You may request account closure by contacting hello@therapick.com or by using available dashboard functionality.
Upon termination, your right to access and use paid or account-only features will cease, but we may retain certain information as required or permitted by law, for billing, security, compliance, fraud prevention, dispute resolution, backup, and legitimate business purposes.
This Agreement is governed by the laws of the State of California, without regard to conflict-of-law rules, except that the Federal Arbitration Act governs the interpretation and enforcement of the arbitration provisions below.
Before starting arbitration or filing a claim, you agree to first email hello@therapick.com with a written description of the dispute and allow us thirty (30) days to attempt informal resolution.
Please read this section carefully. It affects your legal rights, including your right to file a lawsuit in court.
Except for claims that qualify for small claims court and claims seeking temporary or preliminary injunctive relief to protect intellectual property or prevent unauthorized access or misuse, any dispute, claim, or controversy arising out of or relating to this Agreement or your use of Therapick will be resolved by binding individual arbitration.
Arbitration will be administered by JAMS under its then-current Streamlined Arbitration Rules and Procedures, unless the parties agree otherwise. Arbitration may take place in California, by videoconference, or at another mutually agreed location.
You and Therapick each waive any right to a jury trial and any right to participate in a class, collective, consolidated, or representative action. The arbitrator may award relief only on an individual basis and may not consolidate claims of multiple parties.
You may opt out of this arbitration provision by sending written notice to hello@therapick.com with the subject line "Arbitration Opt-Out" within thirty (30) days after you first accept this Agreement. The notice must include your full name, the email associated with your account or use of Therapick, and a clear statement that you wish to opt out.
If arbitration does not apply or if a claim properly proceeds in court, the state and federal courts located in Los Angeles County, California, will have exclusive jurisdiction, and you consent to personal jurisdiction and venue there.
If any portion of this section is found unenforceable, that portion will be severed and the remainder will remain in effect, except that if the class-action waiver is found unenforceable, the arbitration requirement will be void to that extent.
We may update these Terms from time to time. When we make material changes, we will update the "Last Updated" date and may provide additional notice by email, dashboard notice, checkout notice, or other reasonable means where appropriate or required by law. Your continued use of Therapick after the effective date of updated Terms constitutes acceptance of the revised Terms.
If you have questions, notices, or disputes regarding these Terms, you may contact us at:
